EACC recovers Ksh10M from former Homa Bay County official

The Ethics and Anti-Corruption Commission (EACC) has secured court orders for the restitution of Kes10,991,712 in salaries irregularly earned by Mr. Odhiambo Ottoman Adel Walter, a former Deputy Director of Health – Preventive and Promotive at the County Government of Homa Bay.

The court ordered him to refund all salaries paid to him by the County Government of Homa Bay for the period between June 2016 and August 2021, amounting to Ksh10,991,712. It further directed that the amount be refunded within 90 days, failing which the Commission will be at liberty to execute the decree.

The ruling followed a suit filed by the Ethics and Anti-Corruption Commission (EACC), which sought to recover public funds allegedly lost through unlawful payments. The court found that the defendant had been irregularly appointed as the County Deputy Director of Health—Preventive and Promotive Services in March 2016 while still serving as a full-time Lecturer II at the Kenya Medical Training College (KMTC).

Evidence presented in court showed that the defendant did not resign from his KMTC position after securing the county job. Instead, he continued to draw salaries from both institutions between June 2016 and August 2021.

During this period, he received over Kshs 10.9 million from the Homa Bay County Government despite failing to offer any services in that role.

In its ruling, the Anti-Corruption Court noted that it was unlawful and unethical for a public officer to receive salaries from two government institutions in a way that undermines efficient service delivery.
